Here comes another weapon ban>
BETHPAGE — A Long Island man is accused of breaking into a home and attacking the resident with a wooden table leg.
Nassau County police say Albert Garfield crashed through the fence in the driveway of the victim's Bethpage house around 8 a.m. Thursday. He then allegedly kicked in the door of the house and started beating the 50-year-old victim.
The victim was treated at a hospital for multiple contusions and abrasions to his head.
About two hours later, police say Garfield stole a car from a woman waiting to have it serviced at a Kia dealership.
Garfield was charged with assault, grand larceny, criminal possession of a weapon and driving while ability impaired by drugs.
The motive for the crimes and whether Garfield had a lawyer were not immediately known.

How will a "criminal possession of a weapon" charge hold up in court?
Has the weapon been identified? Was it of insufficient size to do real harm?
Was it only made of wood—and not cast iron?
With the drugs the perp took, can his lawyer say he was "over-served"?
It's a good thing the 50-year-old wasn't arrested—for resisting the attacker.
...and New Hampshire is beating back their own "Stand your Ground" laws.

I think whether it was a metal or wooden leg makes a big difference. That will decide if it will be first or degree assault!!!
